Terms of Service

Welcome to Circle. By downloading, accessing, or using the Circle iOS application or website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Circle is a network of people. Every account must correspond to one identifiable living human being who personally controls it. Accounts operated for, or in the character of, a business, brand, product, campaign, publication, collective, pet, fictional character, meme, parody, or mascot are prohibited without exception. So are automated, scripted, and bulk-registered accounts. You may hold one account only. You may not sell, rent, lend, transfer, or otherwise make your account available to any other person.

You confirm that you are at least 18 years of age and that the identity information you provide is true and belongs to you. We may require verification at any time and may withhold access until it is provided. An account we determine is not operated by the human being it represents will be terminated and its contents deleted, without notice.

We accept without argument that some people produce genuinely considered, high-quality work with generative tools. That fact is immaterial here. It sits on one side of a coin whose other side is an unmanageable volume of low-effort synthetic material, and the category cannot be admitted at all without destroying the only thing this platform exists to protect.

You may not upload, post, link to, or otherwise introduce to Circle any image, photograph, video, audio, music, writing, or other material that was generated or materially altered by a generative artificial intelligence system. This prohibition is absolute. It applies regardless of quality, effort, intent, disclosure, or labelling.

Breach will result in the permanent termination of your account and the irreversible deletion of all content associated with it. This sanction applies on first breach. We use both automated detection and human review, our determination is final, and no restoration or export will be offered.

Circle is not a rating, ranking, or review service and must not be used as one. That you may add an item, and that you may discuss it, does not make this a venue for consumer criticism.

Adding something here is an act of endorsement. The presence of an item in your account is itself the statement that you value it. There is no negative expression available to you by design, and none may be manufactured from the tools that are.

Introducing content for the purpose of criticising, mocking, warning against, downranking, or otherwise disparaging its subject is a breach of these Terms. We recognise this judgement requires context. A considered remark is not a review, and honest discussion of something you genuinely care for is expected and welcome. The assessment rests solely with our reviewers and their decision is final. Deliberate or sustained use of the platform as a review channel will result in suspension or termination.

Circle is a private service. It is not a public square, a common carrier, or a democracy, and no right of free expression attaches to your use of it.

Your access is conditional at all times on your compliance with these Terms, with our Community Guidelines, and with any standard of quality we set and revise at our discretion. We are not obliged to give notice before acting, and we do not undertake to justify, debate, or re-hear a moderation decision.

Content that is unlawful, harassing, hateful, threatening, sexually explicit, exploitative of minors, deceptive, promotional, or that otherwise degrades the quality of the platform will be removed. Accounts responsible for it will be terminated immediately and permanently. We may retain records as required by law and report conduct to the relevant authorities. There is no shortage of platforms that operate on other principles. This is not one of them.

You retain full ownership of all content you create. All lists, spots, notes, music tags, and photos you commit to your collections remain your intellectual property. We do not claim ownership over your personal memories or curation.

By publishing content publicly or allowing your collections to be shared on Circle, you grant Sruper Inc. and our peer users a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, cache, reproduce, adapt for display, distribute within the service, and publicly display that content for the purposes of operating, developing, securing, and promoting Circle. The licence continues for as long as the content remains on the service and for a reasonable period afterwards, so that routine backups may expire.

You represent and warrant that you own or hold every right necessary to grant that licence for everything you add, and that your content infringes no copyright, trade mark, moral right, privacy right, right of publicity, contractual obligation, or applicable law.

You acknowledge that when you save a link, reference, or third-party item, our systems may automatically retrieve, download, cache, transcode, and store copies of the associated material — including images, artwork, previews, audio, and metadata — on our servers and on our content delivery infrastructure. That retrieval is performed at your direction and on your instruction. You are solely responsible for the lawfulness of everything you introduce to the service by any means, whether uploaded by you directly or fetched automatically as a consequence of your action.

You consent to our collection and processing of the data your use of the service generates. This expressly includes sequential and behavioural data: the order in which you move through a collection, what you open, what you pass over, what you substitute, how long you stay, and the routes you take between one thing and the next.

You agree that we may use this data to develop, train, evaluate, and improve models and systems, including machine learning models, and that we may retain the resulting models and derived statistical outputs indefinitely, including after your account is closed.

Data used for these purposes is de-identified and aggregated before it enters any training process. It is severed from your name, your account, and your contact details, and the resulting models are not designed to reproduce or reveal any individual's personal information. We do not sell your personal data.

What we collect, why, on what lawful basis, how long we hold it, who processes it, and the rights available to you — including access, rectification, erasure, portability, and objection — are set out in full in the Privacy Policy, which forms part of these Terms.

Admission to Circle is granted at our discretion and may be withdrawn at any time. Invitations and access codes are personal to you and may not be sold, published, or distributed.

You may not circumvent or attempt to circumvent any access control, rate limit, or moderation system; scrape, crawl, harvest, or index the service or its contents by any automated means; reverse engineer, decompile, or interfere with the operation, security, or integrity of the service; use the service to advertise, solicit, recruit, or conduct commercial activity; impersonate any person; or access an account that is not your own.

You are responsible for the security of your credentials and devices, and for all activity conducted through your account. Notify us immediately of any unauthorised use.

We may suspend or terminate your account, remove any content, and refuse service at any time, with or without cause and with or without notice. Where an account is terminated for breach of the first four sections above, deletion is permanent and irreversible, no copy will be returned to you, and re-registration is prohibited.

Circle is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We are not liable for network sync interruptions, third-party API downtime, or data loss. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any content will be preserved.

To the fullest extent permitted by law, we exclude all liability for indirect, incidental, special, consequential, exemplary, or punitive damages, and for any loss of data, content, profits, goodwill, or opportunity. Our total aggregate liability arising out of or in connection with the service is limited to the greater of the sum you paid us in the twelve months preceding the claim, or fifty pounds sterling. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be excluded.

We may amend these Terms at any time and will ask you to read and confirm them again when we do. Continued use after an amendment takes effect constitutes acceptance.
